I agree to abide by the provisions of Capital Express Mail, LLC and agree not to use the services offered in a fraudulent manner. Purchases of merchandise will not be processed if they are deemed illegal for handling by the mailing services offered by postal couriers. Understand that Capital Express Mail, LLC does not knowingly handle any illegal items through this service.

I HAVE READ AND AGREE TO THE TERMS AND CONDITIONS ( below )

This Agreement between Applicant and Capital Express Mail, LLC shall be governed by the following terms, agreed to by both and acknowledged by Applicant clicking on the "I HAVE READ AND AGREE..." button listed above:

1. Capital Express Mail, LLC services consist of receiving order(s) from its Members, purchasing the item(s) ordered using a deposit provided by its Members, and sending the purchased items to the Member's specified local address during regular business hours.   The postage deposit towards shopping orders may be included when you register or can be submitted when you are ready to order.  No orders will be placed by Capital Express Mail, LLC until all required deposits are received.

2. The shopping service may be used to purchases only physical merchandise.  This service CANNOT be used to pay for any type of services, including but not limited to: internet services, credit card payments, bill payments, and loan payments.  All orders will be processed by Capital Express Mail, LLC and the items will be sent to our receiving location.  We CANNOT receive merchandise that has been purchased directly by our Members.  Once you are a Member, to place an order send an e-mail to service@capitalexpressmail.com providing us with details about your order. You will be notified by e-mail when your order has been successfully processed.  Once your payment has cleared, Capital Express Mail, LLC will place the order on your behalf then forward item(s) to you. Before placing the order with us the customer must ensure that the item(s) are in stock.  Items that are available at the time of processing the order will be ordered.  We will notify you in the event that an item is not available when we attempt to process the order.

3. All charges and costs generated directly from activity on a Member's behalf, including but not limited to postage, taxes, customs duties, and service fees presently in effect or established in the future, are the responsibility of the Member.  Funds must be available in the Member's account with Capital Express Mail, LLC to cover the cost to purchase and have the items delivered to us. You will be notified by e-mail, when the item(s) ordered have been received and are ready to be forwarded to you. All orders are subject to a $10.00 handling fee, and an additional 4% fee for Member payments made via Paypal or credit card.  Member payments made via wire transfer, money order, or check, are not subject to the 4% fee. There is a $20.00 fee to receive a wire transfer. Capital Express Mail, LLC may require a payment method other than Paypal/Credit Card for orders that exceed $300.

4. The Member is responsible for prompt payment of Shipping and handling charges, and charges for all additional /optional services selected by the Member.  Capital Express Mail, LLC will return an order based on the guidelines of the vendor's return policy.  Refunds for returned merchandise will be applied to the Member's Capital Express Mail, LLC account as a credit only. Other than as set forth in paragraph 6 below, no refunds will be returned back to Members.  All shipping fees to return the order will be paid by the Member. The Member will be credited for the amount that was actually refunded for the returned order after the vendor receives the returned package and has refunded Capital Express Mail, LLC.  In the event the Member decides to cancel an order after it has been processed by Capital Express Mail, LLC, the Member must notify Capital Express Mail, LLC of the decision to cancel the order.  Capital Express Mail, LLC will attempt to cancel the order subject to the rules and policies of the vendor.  If the order is successfully cancelled, the Member will be assessed a cancellation charge of $20.00.  Changes to the orders are NOT allowed once an order has been successfully processed.

5. The Member agrees to comply with all applicable laws and regulations in effect in both the U.S.A. and his/her country.  The Member agrees not to use the Capital Express Mail, LLC service to either receive or send illegal materials or controlled substances.  The Member is solely responsible for any penalties or fines resulting from a violation of applicable laws or regulations.  Applicant agrees to indemnify and hold harmless Capital Express Mail, LLC from and against, and will promptly pay upon demand the amount of, any and all losses, liabilities, claims, costs (including, without limitation, costs of investigation and defense), damages, and expenses (including, without limitation, attorneys fees) which Capital Express Mail, LLC may sustain resulting from, arising out of, relating to or caused by any action, claim, or demand alleging a breach, by Applicant of any covenant or other agreement of Applicant contained in this Agreement.

6. Either party may cancel this agreement upon a minimum of thirty days prior written notice.  Refunds will be processed within fifteen (15) business days of receipt of written requests for termination. Capital Express Mail, LLC will have the option to return all items to the senders at Member's expense or to forward all such correspondence to the Member at the non-Member shipping rates in effect at the time, and the Member agrees to compensate Capital Express Mail, LLC for all such costs.

7. If a Member does not pay for services rendered for a period exceeding 30 days from the due date, all items may be returned to sender or discarded at the sole discretion of Capital Express Mail, LLC.

8. Once Capital Express Mail, LLC has forwarded Member's mail by depositing it with the United States Postal Service or a commercial shipping company, the mail shall be deemed to have been delivered and Capital Express Mail, LLC will not be held responsible for loss, theft or damage.

9. If a Member refuses to accept any mail or package, we may return the mail or package to the sender and the Member will be responsible for any postage or others fees associated with such return.

10. Packages and parcels stored for longer than 30 days will be charged a minimum monthly storage fee of $1.00 per 1 pound of package(s) and parcel(s).   For example, stored mail, packages and parcels that weigh up to one (1) pound will be charged a monthly storage fee of $1.00. And stored mail, packages and parcels weighing more than one (1) pound up to and including two (2) pounds will be charged a monthly storage fee of $2.00 and so on.
  
11. Activation of your shopping account and its use will represent your acceptance of this agreement and the authorization to bill you to maintain the minimum postage deposit.

12. Capital Express Mail, LLC reserves the right, in its sole discretion, to change, modify, or otherwise alter these terms and condition anytime. Please review the terms and conditions periodically. Your continued use of site following the postings of changes and/or modifications will constitute your acceptance of the re-terms and conditions.

13. Capital Express will cooperate fully with law enforcement and government agencies regarding investigation of a Member’s use of this service.

14. CAPITAL Express Mail, LLC, ITS OFFICERS, DIRECTORS, AGENTS, EMPLOYEES, CONTRACTORS AND SUPPLIERS PROVIDE THE SERVICE "AS IS" AND WITHOUT ANY WARRANTY OR CONDITION, EXPRESS, IMPLIED OR STATUTORY.  CAPITAL Express Mail, LLC, ITS OFFICERS, DIRECTORS, AGENTS, EMPLOYEES, CONTRACTORS AND SUPPLIERS SPECIFICALLY DISCLAIM ANY IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.  Some states do not allow the disclaimer of implied warranties, so the foregoing disclaimer may not apply to you.  This warranty gives you specific legal rights and you may also have other legal rights that vary from state to state.  IN ADDITION, CAPITAL Express Mail, LLC SPECIFICALLY DISCLAIMS ALL WARRANTIES THAT THE SERVICES WILL MEET MEMBER'S REQUIREMENTS, WILL ALWAYS BE AVAILABLE, ACCESSIBLE, UNINTERRUPTED, TIMELY, OR OPERATE WITHOUT ERROR; ANY IMPLIED WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE; AND ANY OBLIGATION, LIABILITY, RIGHT, CLAIM OR REMEDY IN TORT, WHETHER OR NOT ARISING FROM THE NEGLIGENCE OF CAPITAL Express Mail, LLC.  TO THE FULL EXTENT PERMISSIBLE UNDER APPLICABLE LAW, CAPITAL Express Mail, LLC DISCLAIMS ANY AND ALL SUCH WARRANTIES.

15. GENERAL To the maximum extent permitted by law, this agreement is governed by the laws of the Commonwealth of Virginia, U.S.A., except for its conflict of law rules, and you hereby consent to the exclusive jurisdiction and venue of courts in Henrico County, Virginia, U.S.A. in all disputes arising out of or relating to the use of the Capital Express Mail, LLC Web Site and services. Use of the Capital Express Mail, LLC Web Site is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph. You agree that no joint venture, partnership, employment, or agency relationship exists between you and Capital Express Mail, LLC as a result of this agreement or use of the Capital Express Mail, LLC Web Site. Capital Express Mail, LLCs performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of Capital Express Mail, LLC's right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Capital Express Mail, LLC Web Site or information provided to or gathered by Capital Express Mail, LLC with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.
